These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "You", "Your") and Arqis Global Trading LLP, a Limited Liability Partnership incorporated under the Limited Liability Partnership Act, 2008, with its registered office at Lightbirdge, 6th Floor, Hiranandani Business Park, Tunga Village, Chandivali, Mumbai, India (hereinafter referred to as the "Company", "We", "Us", or "Our").

Notwithstanding anything to the contrary contained herein, the total liability of the Company to you for any and all claims arising out of or in connection with these Terms or your use of the Website shall not exceed INR 50,000 (Indian Rupees Fifty Thousand only).

11. GOVERNING LAW AND JURISDICTION

These Terms and your use of the Website shall be governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of law principles. You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the competent courts located in Mumbai, India.

 

12. DISPUTE RESOLUTION

Any dispute, controversy, or claim arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts mentioned in Clause 11. The parties may, by mutual written agreement, elect to resolve any dispute through arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Mumbai, and the language of the arbitration shall be English.

 

13. TERMINATION OR SUSPENSION OF ACCESS

We reserve the right, in our sole discretion, to terminate or suspend your access to all or part of the Website, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

 

14. MODIFICATION OF TERMS

The Company reserves the right, at its sole discretion, to modify or replace these Terms at any time.
